According to to The RCMP Nothing can be sold under 366 FPS.

1. Air guns that are firearms for purposes of both the Firearms Act and the Criminal Code (your PAL air rifles, +500fps)

2. Air guns that meet the Criminal Code definition of a firearm, but are deemed not to be firearms for certain purposes of the Firearms Act and Criminal Code. (our 'Uncontrolled Firearms', 367-499fps)

3. Air guns that are replica firearms. "..These are air guns not powerful enough (less than 366fps) to cause serious injury or death, but designed to resemble a real firearm with near precision. Replica firearms... are classified as prohibited devices. These ..devices that have a low muzzle velocity and muzzle energy, [.....] below 366 fps, and resembling with near precision an existing make and model of a firearm, [.....] , [are] a replica firearm and therefore a prohibited device..."

4. Air guns that are neither firearms nor replicas. These are air guns that are not powerful enough to be classified as firearms and that do not resemble a real firearm closely enough to be considered a replica. An example would be a harmless air gun made out of clear plastic or a device that is obviously a child's toy. Nerf Guns.

i have vintage pistols that shoot sub 350fps but they are their own stand alone designs, not "designed to resemble a real firearm with near precision".

i read on another forum that these classifications are closely tied to CBSA as they needed criteria to determine what was 1. a firearm, 2. an uncontrolled firearm, 3. a device that replicates a firearm or 4. a toy.

a big house bar of soap carved to look like derringer coloured w shoe polish is a prohibited device [because] that is a replica (of a) firearm, and apparently so could be a BB GEN 4 Glock.

And the definition is missing the Airsoft guns that shoot 6mm plastic BBs which usually more close ( resemble as precision ) to the real guns than the steel BB guns...

no, the 366fps thing pertains to "...air guns* not powerful enough to cause serious injury or death, but designed to resemble a real firearm with near precision..."

-air (pneumatic system)
-spring (spring-air)
-gas (CO2/nitrogen), strictly speaking not "air guns," are subject to the same rules.."

Attempting to interpret legalese is a fail, fail situation. Statutes such as these are/were written to allow a broad interpretation by
police and courts alike. Such is the case with most firearms legislation as now, the RCMP firearms branch has been given new
powers of interpretation & also it appears, legislative power as well, being able to write law, by the current Federal Government.

We all know that in order to be classified as a firearm, an air gun, whether CO2, PCP or spring powered, must develop OVER 500fps & 4.2fpe.
We also know just this year, our own members here, have been told by the police that only 500fps needs to be surpassed. At least, thus far,
the 4.2fpe ALONE hasn't been declared as the deciding factor. Imagine if that were the case. Perhaps they realized that would produce a licensing
nightmare.
